Young Lawyers Assist with Hurricane Relief Efforts

In the aftermath of Hurricane Katrina, state and local bar associations immediately began to organize massive relief efforts in Texas to assist disaster victims. Now in the wake of Hurricane Rita, which caused heavy damage and destruction in eastern Texas and western Louisiana, TYLA is again mobilizing to provide assistance to those in need. Here's an update on what has been done and what lies ahead--thank you for your help thus far!

2006 National Trial Competition _ Largest Competition Ever!

For the second year in
a row, the National Trial Competition (NTC) has seen
record-breaking registrations for its annual law school mock trial competition.
The competition, which is open to all 190 currently ABA-accredited law schools
in the United States, is co-sponsored by the Texas Young Lawyers Association
(TYLA) and the American College of Trial Lawyers (ACTL). This
year 150 law schools (and over 250 teams) are competing in
the 13 regional competitions around the country. Regional
competitions are being held the first three weekends in February. The top
two teams from each region will advance to the championship rounds being held
in Dallas from March 23-25, 2006.

Chief Justice Jefferson swears-in Karin Crump as TYLA President and Gindi Eckel Vincent becomes Chair of the Board

On June 16, 2006, Chief Justice B. Wallace Jefferson swore-in Karin Crump of Austin as the 80th president of the Texas Young Lawyers Association, and only the 5th woman president since the organizations creation in 1930. The ceremony took place at the Austin Hilton, during a reception where former and current members of TYLA gathered to applaud outgoing President Lee Ann Reno of Amarillo and outgoing Chair William ("Bill") Miller of Texarkana, as well as to support the succeeding leadership of Karin Crump and Chair Gindi Eckel Vincent of Houston. Bill Miller passed the gavel to Gindi Eckel Vincent, who ascended to the position of Chair.

Older Lawyers are Young Again!

During the TYLA Annual Meeting in June, members unanimously approved a by-law change to expand TYLA membership to include lawyers over the age of 36, but still within their first 5 year of licensure. Before the by-laws were amended, only lawyers over 36 years of age and within 3 years of licensure as well as the traditional “young” lawyer who was 36 or younger received the benefits of TYLA membership.

St. Mary's Law School Wins TYLA's State Moot Court Competition
July 12,2006 -
TYLA conducted its annual State Moot Court competition last month during the State Bar Annual Meeting. As in the past, State Moot was a success. This year the problem was a civil case concerning a putative parenting contract between a birth-mother and a donor-father. Seven law schools from around Texas participated in the three day event: Baylor, Houston, St. Mary's , South Texas College of Law, Southern Methodist, Texas Tech, and Texas Wesleyan.

TYLA Plans Year at First Board Meeting

On August 25th and 26th, the TYLA Board of Directors met in New Braunfels, Texas for the first quarterly meeting of the year. Board members reported on the status of twenty committees, and authorized funding for grant requests from several local bar affiliates. Due to changes in its by-laws, TYLA now serves not just lawyers 36 and younger, but also lawyers who have been practicing 5 years or less. As a result, TYLA now represents more than 25,000 attorneys.

Reflections of a Nomadic Associate
(or, the Not-So-Ex-Ex-Pat) I write this column to share a few thoughts on what I have learned from a fairly nomadic career path, and how valuable bar service has been in my various transitions. I started out with Haynes and Boone's Austin office. After practicing there for two years, I decided to pursue opportunities in our Dallas office. And then, after two years in the Dallas office, I found myself unexpectedly moving up to Haynes and Boone's New York City office (I'm keeping my fingers crossed for a London office!). Each of these moves, exciting though they were, presented significant professional challenges. I had developed wonderful professional relationships inside and out of the Austin and Dallas offices, and hated to leave them behind. And each new city presented an unexplored professional community with whom I had almost no ties. In many ways, I was starting from scratch.

TYLA/ProBAR Unaccompanied Children’s Project

Each year, more than 6,000 unaccompanied children reach the United States border after fleeing abuse, neglect or persecution in their home countries. Approximately 25% of those detained children are held in the Rio Grande Valley . This year, the Texas Young Lawyers Association (TYLA) partnered with the South Texas Pro Bono Asylum Representation Project (ProBAR) to help provide a voice to those children.
Created in 1989 by the State Bar of Texas, the American Bar Association, and the American Immigration Lawyers Association, ProBAR has become an integral part of the legal community in South Texas . It is a national effort to provide legal services to immigrants, including children, who are detained in South Texas. By recruiting, training and coordinating the activities of volunteer attorneys, law students and legal assistants, ProBAR has been successful in winning several political asylum cases for minors in detention. However, as the number of detained children rises every year, the need for Texas attorneys to take action increases.

My four year old son, Jake Austin, loves to read Dr. Seuss books. Most children do. Although he likes everything the good doctor published, his favorite is the book Fox in Socks . This is his favorite particularly because he loves laughing at me as I try to read the book as fast and I can, and inevitably make a fool of myself. He likes it even more though because the book contains a disclaimer on the front page that says “This book is dangerous!” There is nothing quite like Jake looking at me with fire and excitement in his eyes when he says “let's read the dangerous book”.

The participants interviewed for They Had a Dream Too: Young Leaders of the Civil Rights Movement were part of something that changed a nation. They Had a Dream Too, TYLA’s newest high school curriculum project, is designed to inspire and educate 11th and 12th graders about the important and often little-known role of students, teenagers and children in the Civil Rights Movement.

TYLA Encourages Young Minorities to Enter Legal Profession

The Texas Young Lawyers Association, through the Minority Involvement Committee participated in the St. Mary’s University School of Law Minority Pre-Law Symposium on February 18, 2006, in San Antonio. The symposium brings together minority pre-law students and local high school students, the nine Texas law schools and their faculties and administrators, as well as practicing minority attorneys, to encourage interactive discussion on the legal practice and how the students begin the steps to their own legal career.
The day started with the keynote address by Eduardo Rodriguez, President of the State Bar of Texas, who shared with the students a slide show of the many minority lawyers in Texas who helped pave the way for other minority lawyers. This slide show was both informative and nostalgic, as it reminded me of the struggles that helped me get to where I am today.

Crossing the Line: Your Rights and Responsibilities

Crossing the Line: Your Rights and Responsibilities is a multimedia project, combining both video vignettes and a curriculum guide to educate middle school age children on common issues that they will likely be faced with in their every day life. The program seeks to encourage young people to take responsibility for their actions and become good judges of what to do and what not to do before ever getting into trouble. Through discussions and group activities, students learn whether a certain activity or behavior is against the law and the punishments that may be imposed for such conduct. A video vignette introduces each of the curriculum topics (including graffiti; criminal mischief; alcohol; curfew; tobacco; truancy; drugs; arson; theft; weapons; assault and disorderly conduct; discrimination; and sexual harassment) and provides a forum for discussing them by showing teens placed in situations they may commonly encounter as well. The video portion is then paused, and the students are invited to discuss the issues to determine the repercussions of each of the situations.

the public service arm of the State Bar of Texas. And though it is true that many
of TYLA’s committees are dedicated to public service projects, the rest
are focused on projects that bring value to our members.
In the current fiscal year, TYLA is striving to educate young
lawyers in new and innovative ways. Two prime examples are the continuation
of the TYLA Roadshow, customized CLE donated to TYLA Affiliates,
and TYLA's Crossroads, a new and exciting CLE seminar designed
specifically for the five-to-ten year lawyer who may be at a crossroads in his
or her career.

This holiday season Rebecca Vela, President of the Hidalgo County Young Lawyers
Association, advises us all to take some time off. She cautions, “No one
will remind you that you need to take your vacation, but you will be much more
productive after the break.” Although she does not always follow her own
advice, like all of us, she is working on it! Currently, Vela is busy in her civil
litigation practice at Kittleman, Thomas, Ramirez & Gonzalez, L.L.P. in McAllen.
She could not imagine a better place to work and describes the nine other attorneys
in the firm as simply “wonderful.” Vela handles an assortment of commercial
litigation and personal injury cases. Her practice allows her to handle both plaintiff

Amarillo Area Young Lawyers Association’s New Lawyer Orientation a Success!

On September 21 st the Amarillo Area Young Lawyers Association (“AAYLA”) held its New Lawyer Orientation and Reception. Through this project AAYLA provided lawyers (both newly licensed and new to the area) a welcoming program. The program included tours of the local courthouses. This tour provided an opportunity to meet federal, district and county judges and the people really responsible for the administration of justice: the clerks. During these meet and greets the new lawyers learned the nuances of practicing in specific courts and the pet peeves of the judges. AAYLA also provided handouts that included information regarding the Amarillo area, applications to the local bar associations, applications for admission to the Northern District, the local bar newsletter, a current copy of the TYLA eNews and letters from the local bar leaders. In addition, TYLA's own Lee Ann Reno spoke to the new lawyers about TYLA and its projects.

Imagine you are a seasoned
trial lawyer at a large, downtown firm. Following a successful “Beauty
Contest” at the New York headquarters of Telco Corporation—a FORTUNE
500 telecommunications company—you are given the opportunity to represent
Telco in future commercial disputes. To prepare, you begin to research Telco
Corporation so that you are familiar with its management, core business, financials,
and other issues potentially affecting future litigation.
During your research, you
quickly discover that Telco is highly dependent on electronic information. For
example, Telco receives up to 300 million external emails a month in addition
to the 90 million internal emails that Telco employees send and receive. Telco
also uses approximately 121,000 backup tapes each month, but it routinely recycles
these tapes according to an internal document retention and destruction policy.
On average, Telco stores approximately 800 terabytes of electronic information
with each terabyte representing 500 billion typed pages. You quickly do the
math and realize that Telco’s electronic information equates to 400 trillion
typed pages. Immediately, you begin to sweat.
You recognize that successfully
navigating electronic discovery will be difficult if you are not proactive in
helping Telco establish proper policies and procedures.

Therefore, it is not uncommon for a large company to store approximately 400 billion typewritten pages of electronic information in its database. In the context of business litigation, this vast quantity of electronic documents is fertile ground for litigants seeking information. Electronic documents and materials, such as e-mail, are an increasingly frequent part of discovery. With this in mind, the Advisory Committee on Civil Rules submitted to the Standing Committee on Rules of Practice and Procedure proposed amendments to the Federal Rules of Civil Procedures to help secure the just, speedy, and inexpensive determination of every action.
