ABA
YLD Louisville Meeting Report
The ABA Young Lawyers Division held
its annual Fall meeting in Louisville, Kentucky on October
6-8, 2005. In the land of the Louisville Slugger, Churchill
Downs and the mint julep, TYLA leaders joined young
lawyers from around the country to plan public and member
service projects for the year and catch up with friends
old and new.
Texas Young Lawyers Highlighted
As usual, Texas young lawyers had a
strong presence at the meeting and TYLA projects were
proudly highlighted at the conference programming. Clay
Scheitzach presented TYLA’s Ten Minute Mentor
project, which has impressed the YLD so much that they
plan to implement the project nationally. (continued)

Dietrich, President
Collin County YLA
It
doesn’t take one long to realize that Alyson Dietrich,
newly-minted President of the Collin County Young Lawyers
Association, is a family girl. Not in the traditional
sense, mind you—she’s yet to settle down herself.
But it is clear that her career and personal life revolve
around an abiding love for and a desire to protect children.

TYLA Project
Texas
Off Campus Recruitment Program
The
Texas Off-Campus Recruitment Program is a collaborative
effort between TYLA and the nine Texas law schools to
provide a unique recruitment opportunity for employers
seeking to hire law students for summer clerkships and/or
associate positions. It is the ideal forum for employers
with diverse or infrequent hiring needs, and for those
who want to supplement annual, formalized recruitment
efforts with a minimal investment of time.
The program, now in its 20th year, is held each Spring
and allows participating employers the opportunity to
interview students from all Texas law schools at one
location. Interview applicants are selected by the employer
through a prescreening process. Interviews will be held
in Houston on March 3, 2006. The
employer registration deadline is January 9, 2006.

Handling
a Bankruptcy Appeal:
Practice Tips for Appeals to the District Court
and the Court of Appeals

An appeal of a bankruptcy court order
involves unique procedural and jurisdictional considerations.
Bankruptcy appeals are different from an ordinary federal
court appeal because of the unusually quick timeframe
for perfecting and briefing the appeal and the likelihood
that such an appeal may be subject to substantive review
by two appellate courts (the district court or Bankruptcy
Appellate Panel and the court of appeals). In approaching
a bankruptcy appeal, practitioners must consider a bankruptcy-specific
jurisdictional statute, a liberalized view of finality,
and a different set of rules depending on whether the
appeal is to the district court or the court of appeals.

Annual Evening With the Judiciary - November 10, 2005

HYLA offers Southern hospitality
to the local judiciary (Federal, State, County, and
Municipal) at the elegant and renowned Brennan’s
of Houston Restaurant on Thursday, November 10. The
event provides a unique opportunity for HYLA members
to meet and converse with the local judges in a social
setting. Last year, nearly 50 of Houston’s distinguished
judiciary attended this highly anticipated annual event.
It continues to be one of HYLA’s signature events,
equally anticipated by both bench and bar. “Many
judges have told us how much they look forward to the
event each year, “ says HYLA President Jill Arntz,
“and the bar has such a unique opportunity to
get to know the judges outside the courtroom and litigation
atmosphere.

You Know?
The State
Bar of Texas was the first bar association in the United
States to create a separate division for legal assistants.
Historically, the terms “paralegal” and
“legal assistant” were largely considered
synonymous and interchangeable. However, as the legal
profession evolved many legal secretaries and other
legal support staff began using the “legal assistant”
title creating the need for more distinct definitions
between the two terms.
Toward
that end, in the spring of 2005, the State Bar's Board
of Directors approved the Division’s name change
from “Legal Assistant Division” to “Paralegal
Division.” Clarifying the definition of paralegals
will assist courts in awarding attorneys fees and will
make clear the types of tasks paralegals handle.
On
April 15, 2005, the Texas House passed a resolution
recognizing October 23, 2005, as Texas Paralegal Day.
