    How Will You Be Remembered?

    This past weekend, I learned something new from the State Bar of Texas. Did you know they honor those among us who have passed on? During a conversation with State Bar President-elect, Roland Johnson, and TYLA President, Sylvia Cardona, I learned that the SBOT had honored Jeff Kubes, a young lawyer whose life was cut short last fall. At the SBOT Board of Directors meeting, the Directors presented the Kubes family with a Memorial Resolution Honoring Jeffery Scott Kubes. (Cont.)

    San Antonio Hosts the 34th Annual National Trial Competition

    If you were in the Bexar County Courthouse during the day on March 26th or 27th, then you probably noticed the invasion of law students upon the courthouse grounds. San Antonio was proud to host the 34th Annual National Trial Competition, which is sponsored annually by the Texas Young Lawyers Association and the American College of Trial Lawyers. This competition is the preeminent mock trial competition and brought law students, lawyers, and judges from across the country. (Cont.)

    TexYLA Awards Local Attorney Demaris Hart with Its First Pro Bono Award

    The Latin phrase pro bono refers to uncompensated legal services performed especially for the public good. Pro bono work is essential, not just to the forty percent of low and moderate income households which experience a legal problem every year, but also for attorney professional development. It allows us to gain legal experience in different fields while truly interacting with members of our community who need someone to step up to the plate to fill their need. (Cont.)

    El Paso Premieres “Healing the Wounds: Navigating the Legal System after Surviving Domestic Abuse”

    On March 20, 2009, at the El Paso County Courthouse, the El Paso Young Lawyers Association (EPYLA), in partnership with the Texas Young Lawyers Association (TYLA), the El Paso District Attorney's Office and El Paso County Criminal Law Court #4, welcomed the El Paso premiere of “Healing the Wounds: Navigating the Legal System after Surviving Domestic Abuse.” The video, available in Spanish and English, includes details on what victims of domestic violence can expect when utilizing the courts to obtain a protective order, temporary restraining order or divorce.

    Procedural Application of “Paid or Incurred”

    Many trial lawyers have argued about the phrase “paid or incurred” since the 78th Legislature passed House Bill 4 in 2003. Section 41.0105 provides as follows: “In addition to any other limitation under law, recovery of medical or health care expenses incurred is limited to the amount actually paid or incurred by or on behalf of the claimant.” Tex. Civ. Prac. Rem. Code Ann. § 41.0105 (Vernon 2008). (Cont.)

    Texas Legislature Convenes
    On Tuesday, January 13th, legislators gathered in Austin for the start of the 81st regular session of the Texas Legislature. On Friday, January 16th, the first edition of the State Bar's legislative enewsletter, the Friday Update, was distributed to subscribers. The free service provides summaries of legislation potentially affecting the legal profession and links to relevant bills. The State Bar is prohibited by a U.S. Supreme Court decision and Section 81.034 of the State Bar Act from lobbying on most issues, but works to keep its members informed. If you subscribed to the Friday Update during the last session, you will automatically receive the new Friday Update . If your email address has changed or you haven't subscribed previously, please visit www.texasbar.com/fridayupdate.

    Hurricane Ike Response Continues
    The storm may be gone, but the need for volunteers and donations to provide legal services to victims of Hurricane Ike continues.  Please see the State Bar of Texas's 2008 Hurricane Response page for details on hurricane relief efforts and resources, including information on donations and volunteer opportunities. The State Bar of Texas has a disaster hotline, (800) 504-7030, to help assist with basic legal questions following a disaster. Hundreds of attorney volunteers are needed to help answer basic legal questions of those affected. Read more.

    The Texas Young Lawyers Association is adding new segments to the Ten Minute Mentor library. Ten Minute Mentor is a TYLA project that debuted in 2004 as a means for sharing concise and practical advice that is always accessible online. Since that time, it has proven its enduring appeal as one of TYLA's most successful projects.     2009 State Bar of Texas Annual Meeting

    State Bar YouTube Contest Winners Announced
    State Bar of Texas President Harper Estes announced the winners of the Bar's second annual YouTube video contest on Friday, April 17, during a red-carpet gala at the Renaissance Worthington Hotel in Fort Worth. For this year's contest, entrants were asked to create an original video on the theme, “Ideals That Unite Us.”

    Winners of a $2,500 scholarship in the under 18 category are brothers Raphael and Alexandre Chaumette of Sugar Land for their video, “Ideals: Every Citizen Counts.” The brothers also won last year in the first-ever bar association YouTube video contest.

    Gabriel Evans of Dallas won $2,500 in the over 18 category for his video, “Memories Unite Us.”

    Manuel Hernandez, Laura Andrade, Laure Bouyssonnade, and Kimberly Carpenter of El Paso picked up the $2,500 prize for the People's Choice Award for their entry, “Raising the Bar for Justice.”

    The contest is part of the State Bar's public education initiative on the importance of the justice system. Texans were invited to create and submit original videos of three minutes or less that captured their vision of the ideals that unite us as citizens.     Entries were judged by Texas Supreme Court Chief Justice Wallace Jefferson, Austin attorney and State Bar of Texas Board of Directors member Michelle Cheng, Dallas entertainment lawyer Tamera Bennett, and University of Texas Radio-Television-Film Ph.D. candidate Nick Muntean.
