    State Bar and TYLA Elections are in Progress ... VOTE NOW!

    State Bar President-elect candidates are Andrew Strong and Gib Walton, both of Houston. TYLA President-elect candidates are Tal Hammock (Texas City) and Bill MIller (Texarkana). Online voting is available April 3 through April 12. Paper ballots will be mailed on April 17 to those attorneys who do not vote electronically and must be returned to the State Bar by 5:00 pm on May 2.

    ABA/YLD Midyear Meeting Report

    The ABA Young Lawyers Division held its midyear meeting during February 2006 in Chicago, Illinois. Although we missed the originally planned location of New Orleans, which is still recovering from Katrina, the young lawyers were in the true Mardi Gras spirit as they kept warm in the windy city. TYLA leaders joined young lawyers from around the country to take part in top-notch programming, participate in the YLD midyear Assembly, and to catch up with friends old and new.     For Derric McFarland, President of the Texarkana Young Lawyers Association, becoming a lawyer was more than fulfilling the potential of a bright young man--he was fulfilling a promise to his parents. Derric McFarland's father, who worked as a meatcutter, told him early on that "there are two ways to make a living, either with your mind or your back." Having grown up watching his father work in a physically demanding job for meager pay, McFarland took his father's advice to heart. And before his mother passed away from cancer when he was 18, McFarland promised her that he would go to law school. This promise gave him the "determination and drive to stick it out" when things weren't so easy. (Cont.)

    Dinner and Dialogue:
    Another Step Toward Inclusion for the Dallas Legal Community

    Dialogue comes from the Greek word dialogos. Logos means "the word" or "meaning of the word" and dia means “through.” To dialogue is to gain meaning and understanding through the flow of words. The act of engaging in dialogue is not passive. It is a gripping experience that requires much from its participants: A willingness to suspend assumptions. To participate equally, without judgment. To listen for understanding.

    On March 16, 2006, more than one hundred Dallas lawyers and judges engaged in a powerful dialogue about race, gender, sexual orientation, politics, religion and familial status. (Cont.)

    Loyola Law School, Los Angeles Wins 2006 National Trial Competition

    Loyola Law School, Los Angeles took top honors for the second year in a row in the National Trial Competition. Championship rounds for the competition were held in Dallas March 22-25, 2006, and included the top teams from around the country who advanced from the 13 Regional Competitions held in February. NTC Coordinator Tracy Brown noted: "When you consider that 150 law schools competed in the regionals this year, and most of those schools entered two teams, it is quite a feat just to make it to Texas to compete for the championship. To win at this level is very exciting."

    Loyola-LA actually brought two teams to Texas and both made it to the semi-final round of the competition. University of Maryland School of Law competed in the final round against Loyola-LA. The American College of Trial Lawyers (ACTL) annually co-sponsor this event and contribute several awards including the Kraft W. Eidman award ($10,000 to the winning team) endowed by Fulbright & Jaworski and $5,000 to the 2nd place team endowed by the firm of Beck, Redden & Secrest. The best oral advocate receives the George A. Spielberg award, donated by Fried, Frank Harris Shriver & Jacobson, which includes a sponsored trip to the ACTL annual meeting.This year Sach Oliver of the University of Arkansas School of Law-Fayetteville was named Best Oral Advocate and will address the ACTL at its annual meeting in London, England.

    I know what you're thinking. You're wondering what all this healthcare privacy rule stuff is about. You're pondering, how does it apply to me and my clients? And where did it come from? Is it an evil parasite that was transmitted to Earth from the planet Neptune? Not quite, but close.

    The HIPAA Privacy Rule is a law, created and enforced by the Federal government, protecting how an individual's health information is used by organizations and disclosed to others. The Federal government has the authority to impose civil and criminal penalties for violations of the Privacy Rule. (Cont.)

    Dear Young Lawyer,

    I write this while still a young lawyer myself (or at least what I consider young these days). I’m not, however, brand new, which may be the distinction I draw when I presume to offer you a bit of advice. This January I became classified an “8th year associate” and have, what I consider, the well earned label of senior associate. Partnership consideration is next – yikes! So I have to ask myself – how did I manage to make it this far without jumping off a bridge from all the stress? I’ve made a series of transitions – mid-sized firm to a small one to a large one, Fort Worth to Houston, litigation to environmental – all of which were made presumably to better my position in this career of mine.     STATE BAR OF TEXAS ANNUAL MEETING

    GOVERNOR CALLS SPECIAL SESSION ON TAX REFORM


    Governor Perry has called an April 17 Special Session on tax reform to address the school funding issue. Perry endorses the Report of the Texas Tax Reform Commission
    , which includes significant franchise tax reforms as part of the financing mechanisms to fund public schools.

    TYLA Affiliates can highlight their local achievements by participating in TYLA's Statewide Awards of Achievement Competition and the ABA-YLD's National Awards of Achievement Competition.

    Applications for the state competition are due April 10, 2006. Applications for the national competition are due June 9, 2006. Both competitions use the ABA-YLD forms, which can be found online.
